General terms and conditions

Agreement to terms

By purchasing, attending, accessing, or participating in any PeakXD training product – including online courses, on-demand modules, live virtual events, in-person workshops, memberships, and supporting resources – you agree to these terms and conditions.

Payment for UX Training Portal - Membership

  • Membership auto-renews and payment will continue to be charged to your card at the end of your billing period (on a monthly or annual basis) until you cancel your membership.
  • The billing period refers to the recurring timeframe for which your membership and portal access is billed. For monthly memberships the billing period is one calendar month from your sign-up or renewal date. For example, if you subscribe on April 10, your next payment will be charged on May 10, or the next business day. For annual memberships the billing period is 12 months from your sign-up or renewal date.
  • You may request a refund within 14 days of signing up for an annual membership. Your annual membership will cease immediately and you will be refunded for the balance of the remaining time, less any bank fees. To cancel your annual membership, please contact training@peakxd.com.au within 14 days of your purchase.

Payment for Scheduled Training Courses

  • Full payment is required at the time of booking unless you opt to receive an invoice when registering.
  • Enrolments will be considered confirmed and the cancellation policy will apply once you register and receive a tax invoice. Please note payment is required to reserve and keep your place in our courses.
  • To pay via invoice on Eventbrite, choose 'Pay by invoice' as the payment type. You will receive an invoice by email as soon as you complete your registration and your place at our course will be reserved. Full payment is due within 7 days of registration or the day before the first day of the event (whichever date comes sooner). Please contact us if your organisation requires more time to pay your invoice. Note a credit card processing fee will be charged if you pay the invoice by credit card. You can avoid this fee by paying by credit card at the time of online registration.
  • Discounts and promo codes must be applied at the time of booking and cannot be applied after this time.

Substitutions

  • Individual licences for the UX Training Portal and Membership are not transferrable. Corporate licences for 3 or more online courses inside the UX Training Portal may be transferred to another person within 30 days in the event that person leaves your organisation.
  • Tickets for in-person or live virtual courses may be transferred to another person, provided 24 hours (1 day) or more notice prior to the event start time has been given.
  • Tickets for in-person or live virtual courses can be transferred to the same course on a different date, provided 30 days or more notice prior to the event start date has been given. However this is subject to availability and may incur a 25% administration fee.
  • PeakXD will not be responsible for any travel costs incurred by registered participants. We encourage participants to book refundable and flexible travel for all of our in-person training courses.

Cancellations

  • To cancel your monthly membership to the UX Training Portal, email training@peakxd.com.au at least 7 days before the of the end of your billing period. Portal access and membership will continue until the end of the billing period.
  • To cancel your annual membership to the UX Training Portal, email training@peakxd.com.au within 14 days of your purchase date. Portal access and membership will cease immediately.
  • In the event that PeakXD postpones or cancels a scheduled course (e.g. due to insufficient numbers), attendees can elect to receive a full refund or have their payment transferred to a future course. We aim to give at least 2 weeks’ notice in the event of cancellation due to insufficient numbers.
  • We reserve the right to change the venue to an equivalent standard and location within 5km of the CBD of the booked city.
  • The quality of our training to attendees is paramount. In the event the trainer is unable to attend a scheduled course (e.g. due to illness), we will endeavour to find a suitable replacement trainer. If this is not feasible, training will be postponed rather than substituting with an inexperienced trainer.
  • From time to time, we may need to change the delivery format of a course (e.g., from in-person to virtual). If this occurs, the course content and learning outcomes will remain the same, and your registration will be automatically transferred to the new format. As the course will still be delivered in full, refunds will not be issued in these circumstances.
  • Cancellations, for any reason, received 30 days or more before the scheduled course start date will incur a 25% administration fee.
  • Cancellations received less than 30 days before the scheduled course start date are non-refundable, though registrations may be able to be transferred to a different person if more than 24 hours (1 day) notice is provided. Please contact us in the event you need to cancel a course for any reason.
  • If an attendee becomes unwell, prior to or during an in-person course and is suspects or is aware that this is due to an infectious disease (e.g., Influenza, COVID), it is a requirement that they do not attend the course in order to prevent the spread of illnesses. In this instance, our standard terms and conditions still apply.  If online courses are available for training content missed, we will endeavour to arrange access to cover any training missed.
  • Email training@peakxd.com.au for cancellations and transfers within the relevant timeframe. We will respond within 1-2 business days.

Intellectual Property

  • All training materials – including videos, recordings, slides, workbooks, templates, exercises, tools, and digital assets – are owned by PeakXD or our licensors. These materials are provided for personal or internal organisational use only. By purchasing, attending, accessing, or participating in any PeakXD training product you have the right to use the data, deliverables, methodologies and frameworks developed by PeakXD.
  • You must not copy, distribute, reproduce, republish, resell, adapt, translate, upload, or otherwise share any training materials outside your organisation, nor use them for commercial purposes, facilitation, reselling, or training others without written permission from PeakXD.
  • All video content (including live virtual sessions and on-demand modules) is for streaming access only. Downloading, recording, screen-capturing, saving, or redistributing videos or audio in any form is strictly prohibited.

Use of AI Tools

  • You must not upload, submit, copy, or input PeakXD training materials – including videos, slides, templates, exercises, transcripts, worksheets, or any proprietary content – into any artificial intelligence tool, machine-learning system, large language model, or automated content-generation platform without our written permission. This includes public AI tools (such as ChatGPT, Gemini, Copilot, Claude), private models, and any third-party system that stores, trains on, or derives new outputs from the content.
  • This clause exists to protect the confidentiality, intellectual property, and commercial value of our materials.

Access and Accounts

  • Access to the UX Training Portal will be granted once payment has been received.
  • Access to the UX Training Portal and other online platforms is provided for individual use only. Passwords and accounts must not be shared. PeakXD may revoke access if misuse is detected or these terms are breached. No refund will be applicable if access is revoked for this reason.

Privacy and Data Protection

  • We collect and handle personal information in accordance with our privacy policy. By accessing our training, you consent to the collection and use of your data as described in that policy.

Behaviour and Participation

  • Participants are expected to behave respectfully and constructively during training activities. PeakXD may remove a participant from an event or platform if behaviour is disruptive, inappropriate, or breaches these terms. No refund will be applicable if you are removed from an event or platform due to your behaviour.

Limit of Liability

  • PeakXD is not liable for any loss, damage, or costs – direct or indirect – arising from the substitution, cancellation, rescheduling, or postponement of any training product.
  • PeakXD assumes no liability if training is altered, rescheduled, postponed, or cancelled due to a fortuitous event, unforeseen occurrence, failure to reach minimum number of attendees, or any circumstance that renders delivery inadvisable, illegal, impracticable, or impossible. A fortuitous event includes, but is not limited to: natural disasters; government restrictions or regulations; war or apparent acts of war; terrorism or apparent acts of terrorism; civil disorder or riots; transport disruptions; or unavailability of the trainer due to illness, health issues, or other emergencies.
  • The tools and methods taught in this course are widely accepted and practiced globally by UX practitioners.  By utilising the tools and methods taught in this course, you do so at your own risk and PeakXD will not be liable for any failures, additional costs or liabilities associated with the use of these methods. Participants are responsible for applying the material appropriately within their context.

Updates

  • PeakXD may update or revise training content and membership benefits at any time. We make no guarantees that course content or member benefits will remain unchanged or available indefinitely.

Governing Law

  • These terms are governed by the laws of Queensland, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Queensland.
